Introduction

Welcome to LOLify. We're committed to providing you with an exceptional experience creating AI-powered personalised gifts that bring joy and laughter to your loved ones.

These are the Terms and Conditions (Terms) on which we supply products and services to you, whether these are physical products, digital content, or marketplace services available on www.lolify.co (Website) or any LOLify Ltd. application (App) in the United Kingdom. These Terms are legally binding.

If you place an order on our Website or App for a product created by LOLify or using LOLify's AI technology, the Contract for the sale of the product is between you and LOLify Ltd..

If you purchase a product featuring a design from our Designer Marketplace, LOLify acts as the platform operator facilitating the transaction between you and the designer, though the contract remains with LOLify Ltd..

Please read these Terms carefully before you submit your order or share content on our platform. These Terms explain who we are, how we provide products and services to you, how either party may change or end the contract, what to do if there's a problem, and other important information.

If you do not agree to these Terms, you must not use our services or order any products.

DEFINED WORDS: In these Terms, bold capitalised words have specific meanings defined in brackets. References to "we", "us", or "our" mean LOLify Ltd.. References to "you" or "your" mean any user or customer.

Document Hierarchy

In the event of any conflict between LOLify's policies:

  1. These Terms & Conditions take precedence
  2. Followed by specific policies in this order:
    • Delivery & Returns Policy (for delivery and returns matters)
    • User Generated Content Terms (for content matters)
    • Privacy Notice (for data protection matters)
  3. More specific provisions override general provisions
  4. The most recent version of any document applies

1. INFORMATION ABOUT US AND HOW TO CONTACT US

1.1 Who We Are

1.3 Response Times

We aim to respond to all enquiries according to the following hierarchy:

  • Acknowledgment: Within 24 hours (business days)
  • Initial Response: Within 48 hours (business days)
  • Resolution Target: Within 5-7 business days
  • Data Requests: Within 30 days (as required by law)
  • Formal Complaints: Acknowledgment within 2 days, full response within 10 days

1.4 How We May Contact You

We will contact you by email or through your LOLify account notifications. For urgent matters regarding active orders, we may contact you by phone if you've provided a number.

1.5 "Writing" Includes Digital Communications

When we use "writing" or "written" in these Terms, this includes emails, in-app messages, and other digital communications.

1.6 Your Status

You must be at least 18 years old to place orders on our Website or App. Users aged 13-17 may browse and create designs with parental consent but cannot make purchases.

2. ORDERING FROM LOLIFY

2.1 Creating an Account

To place an order or share designs in our marketplace, you must create an account (LOLify Account). You'll need to provide:

  • Your real name
  • Valid email address
  • Password meeting our security requirements
  • Optional: Designer profile information if joining the marketplace

2.2 Placing an Order

You place an order by:

  1. Creating or selecting a design
  2. Choosing your product type (greeting card, phone case, t-shirt, etc.)
  3. Personalising with text, images, or AI prompts
  4. Adding recipient details
  5. Proceeding through checkout
  6. Confirming payment

By confirming your order, you agree to purchase the products selected, subject to these Terms.

2.3 Order Acceptance

Your order confirmation email is acknowledgment of receipt, not acceptance. We accept your order when we send a separate acceptance email, creating a legally binding contract (Contract).

2.4 Reasons We May Not Accept Your Order

We may be unable to accept your order if:

(a) Pricing or description errors are identified (b) Your AI prompt violates our Content Rules (Section 3.5) (c) Uploaded images are corrupted, low resolution, or inappropriate (d) The design contains copyrighted material you don't have rights to use (e) Payment cannot be processed or appears fraudulent (f) Products are out of stock (g) Delivery address cannot be verified (h) The order appears to be a duplicate (i) AI generation fails to produce acceptable content after multiple attempts (j) Your account has been suspended for Terms violations

2.5 Order Numbers

Each order receives a unique number included in your confirmation email. Please reference this number in all communications about your order.

2.6 Business Orders

If using LOLify for business purposes, you warrant that:

  • You have authority to act on behalf of your organisation
  • You have appropriate legal basis for sharing recipient data
  • All content complies with your organisation's policies and our Content Rules

3. OUR PRODUCTS AND SERVICES

3.1 Product Types

LOLify offers:

  • AI-Generated Products: Items featuring images created by our AI from your prompts
  • Personalised Products: Items customised with your photos, text, or designs
  • Designer Marketplace Products: Items featuring designs shared by community designers
  • Standard Products: Pre-designed items without customisation

Products available include:

  • Greeting cards (standard and giant)
  • Phone cases
  • T-shirts and apparel
  • Calendars
  • Canvas prints and framed photos
  • Mugs and drinkware
  • Other gift items as advertised

3.2 AI Image Generation

Our AI service:

  • Generates unique images from text descriptions (prompts)
  • Enhances or transforms uploaded photos
  • Creates humorous, stylised content
  • May require multiple generation attempts for optimal results

Important: AI-generated images are owned by LOLify (see Section 3.6 for usage rights).

3.3 Product Variations

  • Images may vary slightly from screen display due to monitor settings
  • Print colours may differ from digital previews
  • Product packaging may vary from images shown
  • Actual product dimensions may have minor variations

3.4 Personalised Products

For Personalised Products, you are responsible for:

  • Checking spelling and grammar
  • Ensuring uploaded images meet quality requirements (minimum 1000px shortest edge)
  • Verifying recipient details are correct
  • Obtaining permissions for any photos featuring identifiable people

Image Requirements:

  • Format: JPEG or PNG
  • Minimum resolution: 300 DPI for printing
  • File size: Maximum 50MB
  • Content: Must comply with Content Rules

3.5 Content Rules

You must NOT create, upload, or share content that:

(a) Intellectual Property Violations

  • Infringes copyrights, trademarks, or other IP rights
  • Uses brand logos without permission
  • Reproduces artwork, characters, or designs you don't own

(b) Illegal or Harmful Content

  • Violates any laws or regulations
  • Promotes illegal activities
  • Contains hate speech or discrimination
  • Incites violence or harm

(c) Inappropriate Material

  • Contains nudity or sexual content
  • Includes profanity or offensive language (unless contextually appropriate for humour)
  • Shows graphic violence or disturbing imagery

(d) Personal Information

  • Includes private data without consent (addresses, phone numbers, etc.)
  • Features identifiable minors without parental permission
  • Contains financial or medical information

(e) Misleading Content

  • Impersonates others or organisations
  • Contains false information presented as fact
  • Creates confusion about product origin or endorsement

(f) AI Prompt Restrictions

  • Requests for photorealistic depictions of real public figures
  • Attempts to generate prohibited content through indirect means
  • Prompts designed to circumvent our safety systems

Consequences of Violations:

  • Immediate order cancellation
  • Account suspension or termination
  • Removal from Designer Marketplace
  • Legal action if warranted
  • Reporting to authorities when required

3.6 Content Ownership and Licensing

IMPORTANT: These ownership rules are fundamental to our service

3.6.1 Your Uploaded Photos

  • You retain full ownership of all photos and images you upload
  • LOLify claims NO ownership rights to your uploaded photos
  • We will NOT use, share, or distribute your photos without your explicit consent
  • We only process your photos for:
    • Printing your orders
    • Creating AI edits (if requested)
    • Temporary storage during order processing
  • You may choose to share your photos as part of product designs in our marketplace
  • Photos are deleted according to our retention policy (90 days after order completion)

3.6.2 AI-Generated Content (From Text Prompts)

  • LOLify owns all AI-generated images created from text prompts
  • You receive a limited licence to:
    • Use AI images on LOLify products
    • Share product designs containing AI images on our platform
    • Purchase products featuring the AI images
  • You may NOT:
    • Download or export AI-generated images
    • Use AI images outside the LOLify platform
    • Claim ownership of AI-generated images
    • Sell or licence AI images to third parties
    • Use AI images for any commercial purpose outside LOLify

3.6.3 AI Edits to Your Photos

  • LOLify owns the AI-edited versions of your photos
  • Your original photos remain your property
  • We will NOT use or share AI-edited versions without your consent
  • You receive a limited licence to:
    • Use AI edits on LOLify products
    • Share product designs containing AI edits on our platform
  • You may NOT:
    • Download or export AI-edited images
    • Use AI edits outside the LOLify platform
    • Claim ownership of the AI edits
  • We only use/share AI edits when you explicitly share a product design

3.6.5 Important Clarifications

  • Purchasing a product does NOT transfer ownership of AI content
  • Sharing designs in marketplace does NOT transfer ownership
  • Other users purchasing your shared designs receive product use only
  • We may use anonymised prompts to improve our AI
  • Deleting your account does not transfer AI content ownership to you

4. DESIGNER MARKETPLACE

4.1 Becoming a Designer

To join our Designer Marketplace:

  • Complete designer profile with portfolio
  • Agree to Designer Terms (supplementary to these Terms)
  • Provide tax information where required
  • Maintain quality standards

4.2 Revenue Sharing

When the Designer Marketplace launches with commission features:

  • Commission rates will be clearly communicated
  • Payments processed monthly (minimum threshold will apply)
  • Full sales reporting provided
  • Designers responsible for their own tax obligations
  • Revenue sharing applies to design usage, not content ownership

4.3 Design Standards

Marketplace designs must:

  • Be original or properly licensed (excluding LOLify AI content)
  • Meet quality requirements
  • Comply with all Content Rules
  • Include accurate descriptions and tags
  • Respect ownership rules in Section 3.6

4.4 Design Removal

We may remove designs that:

  • Violate Content Rules
  • Receive multiple quality complaints
  • Infringe intellectual property rights
  • Become technically incompatible with our systems
  • Violate ownership terms

5. PRICING AND PAYMENT

5.1 Prices

All prices:

  • Include VAT where applicable
  • Are shown in GBP
  • May vary based on product type and customisation
  • Don't include delivery charges (shown separately)

5.2 Payment Methods

We accept:

  • Credit and debit cards (Visa, Mastercard)
  • PayPal
  • Apple Pay and Google Pay
  • LOLify account credit
  • Gift cards

We do NOT accept American Express or cryptocurrency.

5.3 Payment Processing

  • Payment taken immediately upon order confirmation
  • Processed securely through Stripe
  • Card details encrypted and not stored by LOLify
  • Failed payments result in order cancellation

5.4 Promotional Offers

  • Discount codes must be entered at checkout
  • Cannot be applied retroactively
  • May have restrictions on product types
  • One promotional code per order unless stated otherwise

5.5 Price Errors

If we discover a pricing error:

  • Lower actual price: We'll charge the lower amount
  • Higher actual price: We'll contact you for confirmation or cancel with full refund

6. DISPATCH AND DELIVERY

6.1 Production and Delivery

6.2 Summary

  • Standard UK delivery: 1-3 business days after production
  • International delivery: Available for select products
  • Multiple delivery speed options available
  • Tracking available for certain services

6.3 Force Majeure

We're not liable for delays caused by events beyond our control including:

  • Natural disasters
  • Pandemic restrictions
  • Postal strikes
  • Severe weather
  • Government actions

7. YOUR RIGHTS TO MAKE CHANGES

7.1 Cancellation Within 30 Minutes

You may cancel your order for a full refund within 30 minutes of placing it. After 30 minutes, production begins and cancellation is no longer possible.

7.2 Other Changes

Changes to orders may be possible before production starts:

  • Contact Customer Service immediately
  • Provide order number
  • Changes subject to feasibility
  • May affect delivery date

8. YOUR CANCELLATION RIGHTS

8.1 Right to Cancel

For Non-Personalised Products:

  • 14 days from delivery to cancel
  • Full refund upon return
  • Return costs may apply

For Personalised Products:

  • NO right to cancel once order placed (after 30-minute grace period)
  • This is because items are made specifically for you

For Digital Content (design downloads):

  • 14 days from purchase OR until download begins
  • No cancellation once download starts

8.2 Exceptions to Cancellation Rights

You cannot cancel:

  • Personalised or custom-made items
  • Sealed items unsuitable for return (hygiene reasons)
  • Perishable items
  • Digital content after access granted

8.3 How to Cancel (Within 30 Minutes)

  1. Log into your account
  2. Go to Order History
  3. Select "Cancel Order"
  4. Or contact Customer Service

8.4 Refund Process

  • Refunds processed within 14 days
  • Returned to original payment method
  • Delivery costs refunded only for faulty items

9. PROBLEMS WITH YOUR ORDER

9.1 Reporting Issues

You must report any issues with your order within 14 days of delivery. Contact us immediately if:

  • Product is damaged or faulty
  • Wrong item received
  • Quality doesn't meet expectations
  • Order hasn't arrived

Response Times:

  • Acknowledgment within 24 hours
  • Resolution typically within 3-5 days
  • Photographic evidence may be requested

9.2 Our Quality Guarantee

We guarantee:

  • Products match descriptions
  • Print quality meets standards
  • Materials are as specified
  • AI-generated content is appropriate

9.3 Remedies for Problems

For Faulty Products:

  • Replacement (first option)
  • Refund if replacement not possible
  • No double compensation (replacement AND refund)

For Late Delivery:

  • Investigation with carrier
  • Replacement if lost
  • Refund if significantly delayed

For AI Generation Issues:

  • Regeneration attempts
  • Alternative suggestions
  • Full refund if unable to fulfill

9.4 Your Legal Rights

Nothing in these Terms affects your statutory rights as a consumer under UK law, including rights under the Consumer Rights Act 2015.

10. INTELLECTUAL PROPERTY

10.1 LOLify's IP

We own or licence all:

  • LOLify branding and trademarks
  • Website and app design
  • AI technology and algorithms
  • AI-generated images and content
  • AI edits to user photos
  • Marketing materials
  • Standard design templates

10.2 Your Rights

You may:

  • Use our services for personal purposes
  • Share your creations on social media (with attribution)
  • Purchase products for gifts
  • Use your own uploaded content as you wish

You may NOT:

  • Extract or download AI-generated content
  • Use AI content outside our platform
  • Resell products commercially without agreement
  • Copy or reverse-engineer our technology
  • Scrape content from our platform
  • Use our brand without permission

10.3 User-Generated Content

When you share designs publicly:

  • You retain ownership of your uploaded photos
  • LOLify retains ownership of AI elements
  • You grant other users a licence to purchase products with your design
  • We may feature your designs in marketing (with credit)
  • You can remove shared designs anytime

10.4 Copyright Disputes

If you believe content infringes your copyright:

  1. Contact: legal@lolify.co
  2. Provide:
    • Identification of copyrighted work
    • URL of infringing content
    • Your contact information
    • Statement of good faith belief
    • Declaration of accuracy

We follow DMCA procedures for takedown requests.

11. DESIGNER MARKETPLACE TERMS

11.1 Designer Eligibility

  • Must be 18+ years old
  • Provide accurate tax information
  • Maintain active account
  • Respond to customer queries timely

11.2 Commission Structure

Commission rates and payment terms will be communicated when the marketplace commission feature launches. Terms will include:

  • Monthly payment cycles
  • Minimum payout thresholds
  • Payment methods available
  • Transaction fee details

11.3 Designer Responsibilities

  • Ensure design originality (for non-AI content)
  • Provide accurate descriptions
  • Respond to copyright claims
  • Maintain professional standards
  • Pay own taxes on earnings
  • Respect LOLify's ownership of AI content

11.4 Promotion and Marketing

We may:

  • Feature your designs in campaigns
  • Include in email newsletters
  • Share on social media
  • Create promotional materials

You grant us licence for these uses when sharing designs.

12. DATA PROTECTION

12.1 Privacy

We process personal data according to our Privacy Notice: www.lolify.co/privacy

12.2 Security

We implement industry-standard security including:

  • SSL encryption
  • Secure payment processing
  • Regular security audits
  • PCI compliance

12.3 Account Security

You're responsible for:

  • Keeping login credentials secure
  • Notifying us of unauthorised access
  • Logging out on shared devices
  • Using strong passwords

13. LIABILITY

13.1 Our Liability to You

We ARE liable for:

  • Death or injury from our negligence
  • Fraud or fraudulent misrepresentation
  • Breach of your legal rights
  • Faulty products under consumer law

We are NOT liable for:

  • Losses not caused by our breach
  • Indirect or consequential losses
  • Business losses or lost profits
  • Losses from your content violations
  • Circumstances beyond our control

13.2 Liability Limits

Our maximum liability for any order is limited to:

  • Replacement of products
  • Refund of amount paid
  • Reasonable direct losses proved

13.3 Your Liability

You're liable for:

  • Content that violates these Terms
  • Copyright or IP infringements
  • False or misleading information
  • Misuse of our services
  • Indemnifying us against third-party claims from your actions

14. GENERAL TERMS

14.1 Entire Agreement

These Terms constitute the entire agreement between us, superseding any prior agreements or understandings.

14.2 Transfer of Rights

We may transfer our rights and obligations to another organisation. You may only transfer your rights with our written consent.

14.3 Third Party Rights

No third party has rights under this contract except as explicitly stated.

14.4 Severability

If any provision is found invalid or unenforceable, remaining provisions continue in full force.

14.5 Waiver

Failure to enforce any provision doesn't constitute waiver of our right to enforce it later.

14.6 Variations

We may update these Terms. Significant changes will be notified via:

  • Website banner
  • Account notification

Continued use after changes indicates acceptance.

14.7 Governing Law

These Terms are governed by English law. Disputes will be resolved in English courts, though we encourage attempting resolution through our Customer Service first.

15. AI-SPECIFIC TERMS

15.1 AI Service Availability

  • AI generation not guaranteed to be available 24/7
  • Maintenance windows may apply
  • Generation limits may be imposed during high demand

15.2 AI Content Standards

AI will not generate:

  • Photorealistic images of real people
  • Content violating our Content Rules
  • Exact reproductions of copyrighted works
  • Inappropriate content for minors

15.3 Generation Attempts

  • Standard orders include up to 3 generation attempts
  • Additional attempts may incur charges
  • Refund available if unable to generate acceptable content

15.4 AI Improvements

We continuously improve our AI, which may result in:

  • Different outputs from identical prompts over time
  • Enhanced capabilities requiring Terms updates
  • Occasional service interruptions for upgrades

15.5 AI Content Ownership Reminder

  • All AI-generated content remains property of LOLify
  • No download or export functionality provided
  • Platform use only - no external use permitted

16. SPECIAL PROMOTIONS

16.1 Launch Offers

Special terms may apply to launch promotions, including:

  • Limited-time pricing
  • Early access features
  • Beta testing opportunities
  • Founder benefits

16.2 Referral Programme

  • Earn credits for successful referrals
  • Both parties benefit from discount
  • Limits on monthly referrals may apply
  • Cannot refer yourself or same household

AI-Generated Content - Images created by our AI from text prompts

AI Edits - AI-modified versions of user-uploaded photos

Content Rules - Restrictions on user-generated content (Section 3.5)

Designer Marketplace - Platform for sharing and selling designs

LOLify Account - Your registered user account

Personalised Product - Items customised with your content

Prompt - Text description for AI image generation

20. ACCEPTANCE

By using LOLify services or placing an order, you confirm:

  • You've read and understood these Terms
  • You accept and agree to be bound by them
  • You understand the ownership structure for content
  • You're legally capable of entering this agreement
